SermonEcho Terms of Service

1. Acceptance of Terms
Welcome to SermonEcho ("SermonEcho," "the App," "we," "us," or "our"), operated by IGNITEDDY TECH SDN.BHD. These Terms of Service ("Terms") govern your access to and use of the SermonEcho application and related services, including audio recording, transcription, AI-powered summarization, content organization, sharing features, and subscription services.
By downloading, accessing, or using SermonEcho, you agree to these Terms. If you do not agree with these Terms, please discontinue use of the App.
Your use of SermonEcho is also subject to our Privacy Policy, which explains how we collect, use, store, and disclose information in connection with the App.
2. Description of the Service
SermonEcho is an AI-powered recording and content organization application designed to help users record spoken content, convert recordings into text, generate AI-powered summaries and structured notes, identify key topics and highlights, and revisit their recorded content.
The App may provide features including:
Audio recording and playback
Audio-to-text transcription
AI-generated summaries, topics, highlights, and structured notes
Recording and note organization
Content sharing and export features
Push notifications and service updates
Subscription-based features
Certain features may require an active subscription or may be subject to applicable usage limits.
SermonEcho is provided as a technology tool and is not intended to replace professional advice, personal judgment, or independent review of the original recording or source material.
3. AI-Powered Features
SermonEcho uses artificial intelligence and third-party AI processing services to provide certain features, including transcription, summarization, and generation of structured notes and other content.
Before your audio recording is transmitted to our third-party AI service provider for AI processing, we will obtain your separate and explicit consent in the App before transmitting your audio to our third-party AI service provider where required by applicable law.
AI-generated content may contain errors, omissions, inaccuracies, or misinterpretations. For example, the AI may incorrectly recognize words, names, accents, Scripture references, quotations, or speech affected by background noise.
You should review AI-generated content against the original recording or other authoritative sources before relying on it, sharing it, or using it for any important purpose.
We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content.
4. User Content and Recordings
SermonEcho allows you to create and store content, including audio recordings, transcripts, notes, summaries, and other materials generated from your use of the App ("User Content").
You retain ownership of your User Content.
You are solely responsible for the User Content that you create, record, upload, store, or share through the App.
AI-generated transcripts, summaries, topics, highlights, and structured notes generated from your User Content are considered part of your User Content, and you retain ownership of such outputs to the extent permitted by applicable law and the terms of our AI service providers.
By using the recording or content features, you represent and warrant that:
You have the necessary rights and permissions to make and use the recording.
Your recording and use of User Content comply with all applicable laws and regulations.
You have obtained any consent required by applicable law from individuals whose voices or conversations are recorded.
Your User Content does not infringe the rights of any third party, including privacy, publicity, copyright, trademark, or other intellectual property rights.
Recording laws may vary between jurisdictions. You are responsible for understanding and complying with the laws applicable to you and to the individuals whose voices may be recorded.
AI-generated transcripts, summaries, and notes are labeled as AI-generated within the App. When you share such content, the AI-generated label may accompany the shared content where technically feasible.
5. License to Provide the Service
You retain all rights you have in your User Content.
To operate and provide SermonEcho, except that you delete your account or stop using the app, you grant us a limited, non-exclusive, worldwide license to host, store, reproduce, transmit, process, and otherwise use your User Content solely as reasonably necessary to:
Provide the features and services you request;
Process recordings through applicable speech recognition and AI services;
Generate transcripts, summaries, notes, and other requested outputs;
Store and synchronize your content;
Enable sharing or exporting features when initiated by you;
Maintain, secure, troubleshoot, and improve the App and its services; and
Comply with applicable legal obligations.
This license does not give us ownership of your User Content.
Our processing of personal information and User Content is further described in our Privacy Policy.
6. Privacy and Content Visibility
Your privacy is important to us.
Unless you explicitly choose to share or otherwise make content available, your recordings, transcripts, AI-generated summaries, and structured notes are intended to remain private and accessible only to you.
SermonEcho does not automatically publish or distribute your private content.
You may choose to share certain content through available sharing features, including shareable images, links, or other supported methods. Any such sharing is initiated by you, and once content is shared outside the App, it may be subject to the terms and privacy practices of the third-party platform or service involved.

7. Prohibited Uses
You agree not to use SermonEcho:
For any unlawful, fraudulent, or unauthorized purpose;
To violate the rights of another person or entity;
To record individuals without obtaining consent where such consent is legally required;
To upload or distribute unlawful, defamatory, threatening, abusive, obscene, or otherwise harmful content;
To infringe copyrights, trademarks, privacy rights, or other intellectual property rights;
To reverse engineer, decompile, disassemble, modify, or attempt to derive the source code of the App;
To circumvent subscription restrictions, usage limits, security measures, or other technical protections;
To interfere with or disrupt the operation, security, or integrity of the App;
To use automated means to access or interact with the App in a manner that could adversely affect the service; or
To use the App in a manner that violates applicable laws or regulations.
We reserve the right to restrict, suspend, or terminate access to the App where reasonably necessary to protect the service, our users, or our legal rights.
8. Intellectual Property
SermonEcho and all related software, designs, interfaces, trademarks, logos, graphics, and other materials provided by us are owned by or licensed to IGNITEDDY TECH SDN.BHD. and are protected by applicable intellectual property laws.
Except as expressly permitted under these Terms, you may not copy, reproduce, modify, distribute, sell, lease, sublicense, or otherwise exploit any part of SermonEcho without our prior written permission.
These Terms do not transfer ownership of your User Content to us.
9. Subscriptions and Paid Features
Certain features of SermonEcho may require a paid subscription.
Subscription plans, prices, billing periods, trial periods, available features, and applicable usage limits will be displayed to you before you complete a purchase.
If you purchase a subscription through an app store, your purchase is processed by the applicable app store, and the payment, billing, renewal, cancellation, and refund terms of that app store may also apply.
Unless otherwise stated at the time of purchase, subscriptions automatically renew at the end of each billing period unless you cancel the subscription before the renewal date.
Deleting the App does not automatically cancel an active subscription.
You may manage or cancel your subscription through the account settings of the applicable app store.
10. Free Trials and Promotional Offers
SermonEcho may occasionally offer free trials or other promotional offers.
The duration, eligibility requirements, applicable restrictions, and other conditions of any free trial or promotional offer will be presented to you before activation.
If a free trial converts into a paid subscription, the applicable subscription fee may be charged automatically at the end of the trial period unless you cancel before the trial ends.
We may modify or discontinue promotional offers at any time, subject to applicable law and the terms presented when the offer is activated.
11. Payments, Renewals, and Refunds
Payments for subscriptions purchased through the App are processed through the applicable app store or payment platform.
The applicable app store is responsible for processing payments and may determine the applicable payment methods, billing procedures, cancellation procedures, and refund policies.
For subscriptions purchased through Apple or another applicable platform, you should follow that platform's procedures for managing subscriptions and requesting refunds where available.
We do not guarantee that a refund will be available in every circumstance.
12. Third-Party Services
SermonEcho may use or integrate third-party services to provide certain features and functionality.
These services may include authentication providers, AI processing providers, analytics and attribution services, push notification services, cloud infrastructure providers, and content-sharing platforms.
For example, audio recordings may be processed by AssemblyAI when you use AI-powered transcription or summarization features and provide the required consent.
Third-party services operate under their own terms and privacy policies. Your use of such services may therefore be subject to additional terms imposed by the relevant third party.
We are not responsible for the availability, performance, policies, or practices of third-party services that are outside our reasonable control.
We have configured our arrangement with AssemblyAI such that your audio recordings are not used for AI model training purposes.
13. Data Storage and Account Deletion
SermonEcho stores recordings, transcripts, summaries, notes, and other information associated with your account in accordance with our Privacy Policy.
You may delete individual recordings, transcripts, notes, or your entire account through the available settings in the App.
When you delete your account, we will delete or anonymize your personal information within a reasonable period, and we will also instruct our third-party AI service provider to delete your audio recordings and associated data from their servers, except where we are legally required or permitted to retain certain information.
You acknowledge that deletion may be subject to technical processing time and that certain information may need to be retained where required by law or necessary to resolve disputes, enforce agreements, or protect our legal rights.
14. Service Availability and Changes
We may modify, update, suspend, or discontinue all or part of SermonEcho at any time.
Features, functionality, usage limits, subscription plans, and third-party integrations may change as we develop and improve the service.
We do not guarantee that SermonEcho or any particular feature will always be available, uninterrupted, or error-free.
Where required by applicable law, we will provide appropriate notice of material changes.
15. Disclaimer
To the maximum extent permitted by applicable law, SermonEcho is provided on an "as is" and "as available" basis.
We do not warrant that:
The App will always be available or uninterrupted;
The App will be free from errors, defects, or technical failures;
Audio recordings will always be successfully captured, uploaded, processed, or preserved;
Transcriptions, summaries, or other AI-generated content will always be accurate or complete;
The App will meet your particular requirements; or
Content or data will never be lost due to technical failures or circumstances beyond our reasonable control.
You are responsible for maintaining appropriate backups of any content that is important to you.
16. Limitation of Liability
To the maximum extent permitted by applicable law, IGNITEDDY TECH SDN.BHD., its affiliates, officers, employees, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, SermonEcho.
This includes, without limitation, loss of data, loss of recordings, loss of transcripts or notes, business interruption, loss of profits, or reliance on inaccurate or incomplete AI-generated content.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless IGNITEDDY TECH SDN.BHD., its affiliates, officers, employees, agents, and service providers from claims, liabilities, damages, losses, and expenses arising out of or related to:
Your violation of these Terms;
Your User Content;
Your unlawful use of the App; or
Your violation of the rights of another person or entity.
18. Termination
You may stop using SermonEcho at any time.
We may suspend or terminate your access to the App if you violate these Terms, misuse the App, interfere with the operation or security of the service, or where reasonably necessary to protect our users, service, or legal rights.
Termination of your access does not automatically terminate any subscription purchased through an app store. You must separately cancel any active subscription through the applicable platform.
Sections that by their nature should survive termination, including intellectual property, User Content, disclaimers, limitation of liability, indemnification, and governing law, will survive termination.
19. Children's Use
SermonEcho is not directed to children under the age of 13, or the applicable minimum age in your jurisdiction.
You may not use the App if you are below the minimum age required to use the service in your jurisdiction.
Our collection and processing of information relating to children is further described in our Privacy Policy.
20. Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws governing IGNITEDDY TECH SDN.BHD., without regard to conflict-of-law principles, except where otherwise required by applicable law.
Nothing in these Terms is intended to limit any mandatory consumer rights that you may have under the laws applicable to you.
21. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the "Last Updated" date at the top of these Terms. Where reasonably practicable, we may also provide notice within the App for material changes.
Your continued use of SermonEcho after the revised Terms become effective constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.
If you do not agree to the revised Terms, you should discontinue use of the App.
